What is a Nebenkostenabrechnung (service charge statement)?
The Nebenkostenabrechnung (service charge statement) — in legal terms the Betriebskostenabrechnung (operating cost statement) — is the annual settlement of the Betriebskosten (operating costs) allocable to tenants (umlagefähig) between landlord and tenant under § 556 BGB. The landlord must show which costs were actually incurred and how the tenant's share was calculated, offset against the monthly advance payments.
Obligation and deadline
Landlords are obliged to issue a statement as soon as they have agreed an advance payment or a flat-rate amount for Betriebskosten (operating costs) with the tenant. The statement must reach the tenant no later than twelve months after the end of the accounting period (§ 556 Abs. 3 BGB) — after that, a back-payment can no longer be claimed, but a refund to the tenant remains possible.
Which costs are allocable to tenants?
Only the 17 cost types listed exhaustively in § 2 BetrKV are allocable to tenants (umlagefähig) — Grundsteuer (property tax), water, heating, refuse, caretaker, insurance, lighting, lift, chimney sweep and others. Management costs, repairs and maintenance may not be allocated to tenants. Heating and hot water costs must be billed at least 50 % according to consumption under the Heizkostenverordnung (Heating Costs Ordinance).
